IMPORTANT: READ CAREFULLY. This End User License Agreement ("Agreement") is a legal agreement between you ("You") and the author of ColorHead, publishing under the name "inrainbws" (github.com/inrainbws) ("Licensor"), the rights holder, for the ColorHead software, including its executable code, associated files, and documentation (the "Software"). By installing, copying, or using the Software, You agree to be bound by this Agreement. If You do not agree, do not download, install or use the Software.
1.1 "Software" means the ColorHead application authored by the Licensor, excluding the Third-Party Components defined in Section 6.
1.2 "Personal Use" means use by a natural person for that person's own non-commercial purposes, including scanning that person's own film and producing images for personal, artistic, educational, or non-paid use.
1.3 "Commercial Use" means any of the following:
1.4 "Output" means the image files and other data You produce by using the Software to scan or process Your own film or materials.
Subject to Your compliance with this Agreement, the Licensor grants You a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software for Personal Use only, free of charge.
Except as expressly permitted in this Agreement or required by Section 6 or by mandatory applicable law, You may not:
3.1 use the Software for any Commercial Use as defined in Section 1.3;
3.2 distribute, publish, share, sell, rent, lease, sublicense, or otherwise make the Software available to any third party;
3.3 copy the Software except for a single backup copy for Your own Personal Use;
3.4 modify, adapt, translate, or create derivative works of the Software, or use the Software or any part of it to develop, train, or build any other software or product;
3.5 reverse engineer, decompile, or disassemble the Software, or otherwise attempt to derive its source code, except to the limited extent that (a) mandatory applicable law expressly permits it notwithstanding this restriction, or (b) Section 6 requires it in connection with the Third-Party Components;
3.6 remove, alter, or obscure any copyright, trademark, or other proprietary notices in the Software.
The Licensor claims no ownership of Your Output. You own the Output You create with the Software and may use, publish, and sell it freely, including for commercial purposes such as selling your photographs or prints. The restriction on Commercial Use in Section 3.1 applies to the Software itself and to providing scanning services to others, not to the sale or use of images of Your own materials that You produce.
The Software is licensed, not sold. The Licensor retains all right, title, and interest in and to the Software, including all copyrights and other intellectual property rights. All rights not expressly granted to You are reserved by the Licensor.
The Software incorporates third-party open-source libraries (the "Third-Party Components"), listed with their licenses in the Acknowledgements section below. The Third-Party Components are licensed to You under their own respective license terms, not under this Agreement, and nothing in this Agreement limits any rights You have under those licenses.
Certain Third-Party Components are licensed under the GNU Lesser General Public License (LGPL). Notwithstanding Sections 3.4 and 3.5, and to the extent required by the applicable LGPL license, You are permitted to:
Where any conflict exists between this Agreement and the license terms of a Third-Party Component as applied to that component, the terms of that component's license govern with respect to that component.
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. THE LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT IT WILL NOT DAMAGE, CORRUPT, OR LOSE ANY DATA, FILES, OR IMAGES. YOU USE THE SOFTWARE AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSOR SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF IMAGES, OR LOSS OF PROFITS, ARISING OUT OF OR RELATED TO THE SOFTWARE OR THIS AGREEMENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE THE SOFTWARE IS PROVIDED FREE OF CHARGE, THE LICENSOR'S TOTAL AGGREGATE LIABILITY UNDER THIS AGREEMENT SHALL NOT EXCEED ZERO. NOTHING IN THIS AGREEMENT LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER MANDATORY APPLICABLE LAW.
This Agreement and Your license terminate automatically if You breach any of its terms. The Licensor may also terminate this Agreement at any time. Upon termination, You must cease all use of the Software and delete all copies in Your possession. Sections 5, 7, 8, and 10 survive termination.
10.1 If any provision of this Agreement is held unenforceable, the remaining provisions remain in full force, and the unenforceable provision shall be applied to the maximum extent permitted by law.
10.2 The Licensor's failure to enforce any provision is not a waiver of that provision.
10.3 This Agreement, together with the Acknowledgements below, is the entire agreement between You and the Licensor regarding the Software and supersedes any prior understanding on that subject.
10.4 Questions about this Agreement, including requests for commercial licensing, may be directed to the Licensor via github.com/inrainbws.
BY INSTALLING OR USING THE SOFTWARE, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS.

10.1 若本协议任何条款被认定为不可执行，其余条款仍完全有效，且该不可执行条款应在法律允许的最大范围内适用。
10.2 许可方未执行任何条款不构成对该条款的放弃。
10.3 本协议连同下方的致谢，构成您与许可方之间就本软件的完整协议，并取代此前就该事项达成的任何谅解。
